PRIVACY POLICY
SBC Club Inc. (“we”, “our”, “us” and other similar expressions) owns and operates the website sbcapp.ca (the “Website”) and the corresponding web and mobile application(s) we manage and to which the Website redirects, which application(s) is/are named and known as Small Business Community (collectively, the “Application”). Our Website and our Application are collectively referred to as the “Platform”. By way of our Application, we provide online services and digital products.
SECTION 1 – PRIVACY POLICY
We respect and protect privacy of all of users, buyers, and members of our Platform. This Privacy Policy sets forth the data protection and collection practices we employ in connection with our Platform. This Privacy Policy explains how we protect users’ personal information, and the measures taken to comply with applicable privacy and data protection laws. The present Privacy Policy states how personal information obtained by or in connection with our Platform is collected, gathered, stored and used. In addition, the present Privacy Policy specifies the rights granted to users of our Platform in connection with their personal information.
This Privacy Policy has been drafted for all our Platform’s members, users, business owners, and customers (collectively, the “users” and individually, a “user”) to understand how we use, collect, share, and protect users’ information. We request that all users read this Privacy Policy before using our Platform.
By using our Platform, users consent to our collection, usage, and disclosure of personal information according to the terms of this Privacy Policy. Users further agree that we may send emails based on the terms of this Privacy Policy.
SECTION 2 – COLLECTION OF DATA
For reference purposes, personal information includes but is not limited to the user’s full name/business name, e-mail, date of birth, phone number, and home/business address.
Our Platform only collects personal information that is strictly necessary for us to render our services or for purposes of delivering our services. The information we collect will be used to provide services to users as well as communicate with users through e-mail and/or newsletters. Some information on our Platform will be gathered automatically using different tools and plugins.
2.1. Users’ Personal Information Collection
We will collect personal information from users when they create an account on our Platform or upon the usage of any of our given services. We will only collect personal information that is voluntarily provided on our Platform.
To create a user account, users can submit their names, email addresses and phone numbers on our Application, but not our Website. The provision of the user’s email address is mandatory for sign up purposes, and the provision of the user’s phone number is required to place an order on our Application.
2.1.1. Information by Business Owners
The following constitutes a non-exhaustive list of information that will be provided to us by business owners using our Platform. Such information includes, without limitation:
- Full Name
- Email address
- Business Name
- Business Address
- Phone Number
- Payment Related Information
Business owners may submit information or questionnaires for their customers to complete and submit on our Platform. The information inputted by business owners’ customers, at the request of the business owners, shall be transferred to the respective business owners. We shall not store or maintain such information, unless otherwise provided.
2.1.2. Information by Customers The following constitutes a non-exhaustive list of information that will be provided to us by customers using our Platform. Such information includes, without limitation:
- Full Name
- Age
- Phone Number
2.2. Automatic Information Collection
We also collect information that is automatically obtained by general web browsers (such as Chrome, Firefox and Edge, without limitation) and web hosting servers.
This information automatically collected includes but is not limited to Platform usage by users, referring applications and platforms, browser types, language preference, and browsing history.
We may release such information in aggregate form to better our services and improve our Platform. Please note that in aggregate form none of this information allows for the individual identification of a user.
Our Platform may also collect personal identifiable information such as IP addresses and other information collected through the use of cookies and other similar technologies. Some of the personal identifiable information collected automatically includes but is not limited to:
- Browser Information
- Operating System Information
- IP Addresses
- Subscription Status
- Other Types of User-Submitted Content
- Mobile Device Information (such as device identifier, mobile operating system, etc.)
- Page Accessed
- Geographic Location Information
- Information Gathered by Analytics Services
- Time of Visit (by day, week and duration).
SECTION 3 – USE OF COOKIES
Our Platform may use, collect and store cookies on users’ devices. A cookie is a log file that is stored on the user’s device or personal computer. Information collected from cookies will be provided back to our Platform. Our Platform uses cookies to identify and help track the use of our Platform by users.
We primarily use cookies to (i) understand how users are directed to our Platform; (ii) monitor the usage of our Platform; (iii) obtain information regarding the times and frequency of a user visits; (iv) obtain data for analytical purposes; (v) track for purposes of marketing; (vi) report errors; (vii) provide customer service; and (viii) conduct research and development by gathering user data in aggregated form.
The most common types of cookies are session cookies and permanent cookies. Session cookies are temporary cookies that are deleted once the user exits the browser. Permanent cookies remain in the user’s browser until the cookie log files are deleted by the user or expire on their own. Functional cookies are a type of permanent cookie that is necessary to provide certain services offered on our Platform. Our Platform stores these cookies to provide services in connection with third-party integration with our Platform.
Certain browsers may be configured to provide a notification when a user receives cookies. Users can decide to restrict or disable cookies. Users may remove or disable cookies by activating certain browser settings, adjusting cookie settings or turning off cookies. Users recognize that certain parts of our Platform may be unavailable or inaccessible if cookies are disabled or removed. Moreover, our Platform may not function optimally if cookies are disabled or removed.
SECTION 4 – THIRD-PARTY LINKS
We rely on third-party platforms in order to render our services. For the purpose of storing and hosting our data, we primarily use hosting services. Please note that all of these services are changeable and we may use other alternatives at our discretion.
Apart from sharing some of our data with our third-party platform partners, we will not share, lease, or sell any personal user information to a third party, except as set forth in this Privacy Policy.
There will also be a presence of third-party tracking and analytical services links on our Platform, such as Google Analytics, to help us track users’ session activity, bounce rate, time of stay, and general traffic analytics. Most of these links will only be there in order to help us provide our services. Please note any links provided on our Platform are either for marketing purposes or as needed to operate our Platform. These links may or may not be associated or affiliated with us in any way.
We will not sell, trade, rent or otherwise share personal information with third parties without users’ prior consent. Notwithstanding the foregoing, we may share personal information with vendors and other third-party providers who perform services for us in connection with our Platform. The vendors and third party providers we use will only collect, use and disclose personal information to the extent necessary to allow them to perform the services they provide in connection with our Platform.
SECTION 5 – PROTECTION AND SHARING OF USERS’ PERSONAL INFORMATION
We are committed to protecting the personal information of users in accordance with applicable laws. For reference purposes, this Privacy Policy has been drafted in compliance with all data protection and privacy laws applicable in Canada. We implemented measures in order to make sure that all users’ personal information is safeguarded and protected.
We may share users’ personal information in the following instances:
- When we are required by a valid legal order issued by a court of law or legal authority. As such, we may use personal information to comply with the law or legal process served upon us. In such cases, we will disclose the personal information required to comply with the law or to fulfill the legal request, as applicable.
- When our business is transferred or sold to a new company or owner and pursuant to such transaction, the data stored by us will also be transferred to the new owner.
- We may store and transfer users’ personal information out of Canada in order to improve our services. Users of our Platform acknowledge that their personal information may be stored on hosting servers are outside of Canada.
- We may use personal information for purposes of account management and to deliver the services offered on our Platform. More specifically, personal information can be used to create and manage user accounts on our Platform. This includes but is not limited to handling subscriptions and processing payments via or on our Platform.
- We may also disclose personal information to investigate or prevent suspected or actual fraud and illegal activities in connection with our Platform. As such, we may release personal information to entities for fraud protection and credit risk reduction.
- We may share personal information with our affiliates and third parties for purposes of providing services to users. We may share personal information with third party providers who perform services for us, including those who handle our payment processing, data analysis, hosting services and marketing assistance. If we share personal information with any our affiliates, we will ensure our affiliates are subject and bound to the terms of this Privacy Policy.
- We may share non-personally identifiable information, such as anonymous usage data, platform types and number of clicks, with third parties for purposes of serving advertisements on our Platform.
- It is also possible for us to share users’ personal information provided the user gave its prior written authorization. In which case, the personal information shared will be in accordance with the scope and duration set forth in the authorization provided.
5.1. Storage and Retention of Users Information
We store personal information provided by users so long as users have an account on our Platform and use our Platform. Accordingly, we maintain and store the personal information of users who have an active account on our Platform. We may retain personal information for a longer duration to comply with legal obligations. In addition, we may keep personal information on file for payment purposes until all funds owed have been paid or to resolve disputes.
If the personal information is no longer needed, we will either destroy such information or anonymize it. If the personal information is also collected by third parties, then users’ information will be subject to third-party websites and handled according to their privacy protection and data retention policies.
5.2 Disclaimer
We implemented various security measure to protect users’ personal information against unauthorized access and damage. While we use reasonable measures to secure users’ personal information on our Platform, please be aware that no security measures are fully impenetrable and unfortunately, the transmission of personal information over the Internet is never 100% secure. Accordingly, no method of data transmission can be guaranteed against any interception or other type of misuse.
SECTION 6 – USER RIGHTS
In compliance with privacy rights, this Privacy Policy sets forth the rights of users of our Platform in connection with their personal information. All users have the right to access their personal information and the right to know how their information is being stored on our Platform. Users can also request to have their information removed or transferred from our Platform.
As such, the following rights will be available to users in connection with their personal information:
- Right to access: The right to access and be informed of the personal information we have collected and stored. Users may request access to their personal information and a copy thereof by sending an email to support@sbcapp.ca;
- Right to rectification: The right to request modifications and changes to the personal information submitted and collected;
- Right to erasure: The right to request the deletion of any personal information that is inaccurate or false;
- Right to restrict processing: The right to request that we restrict or limit the processing of their personal information;
- Right to object to processing: The right to object to us processing their personal information for a particular reason, or for direct marketing purposes;
- Right to data portability: The right to request a copy of their personal information in an electronic easy to read format.

Please note that we may use a user’s personal information to confirm the user’s identity and satisfy the request. We reserve the right to refuse a request if it is unfounded or does not comply with the terms of this Privacy Policy.
SECTION 7 – MINIMUM AGE
We take the protection of children’s privacy seriously. We do not knowingly collect or solicit personal information from any user under the age of 14. If a user is under the age of 14, the user should not send us any personal information, such as the user’s name or email address.
No user under the age of 14 is allowed to provide any personal information to us. If we discover that we collected personal information from a user under the age of 14, we will promptly delete such information. If a user has reason to believe that we have any information from or about a child under 14, please contact us by sending an email to support@sbcapp.ca.
SECTION 8 – OPT-OUT RIGHT FROM THE E-MAIL LIST
We may send email updates on a regular basis detailing our activities, offers and updates regarding our Platform. Users may “opt out” of receiving such email updates by selecting the unsubscribe link provided in each email and then making the appropriate selections on our Platform to be removed from our mailing list. Users may also unsubscribe to our newsletter by sending us an email.
We may still send users emails relating to user accounts and/or the services on our Platform, such as registration emails, notification emails, and correspondences regarding payments. Users may not opt-out of these email communications as they are not promotional in nature.
SECTION 9 – BUSINESS OWNER OBLIGATIONS REGARDING PRIVACY
Business owners may receive personal information from their customers (i) as part of the business owner’s provision of orders; (ii) when customers submit information to the business owner; (iii) when customers complete questionnaires provided by the business owner; (iv) to provide support to customers; (v) to fulfill orders placed by customers; and (vi) for any other purpose deemed reasonable by the business owner. When receiving and handling customers’ personal information, business owners are required to comply with all applicable data protection and privacy laws and regulations. All such personal information must be handled and stored by the business owner according to laws and regulations in effect.
It is the business owner’s exclusive responsibility, to our exclusion, to verify all applicable data protection and privacy laws and regulations, and ensure the business owner’s compliance therewith. The business owner has a duty to notify its personnel of all such data protection and privacy obligations, thereby ensuring full compliance with such obligations.
The business owner will assume responsibility to assure that all customers’ personal information is handled, collected and stored in accordance with applicable laws and regulations. Moreover, the business owner agrees to comply with instructions, if any, furnished by us relating to the use, collection, storage and handling of personal information. Further, the business owner agrees not to misuse customers’ personal information in any manner. We will not be responsible for the business owner’s collection, handling, storage and usage of customers’ personal information. The personal information provided by customers directly to the business owners will not be subject to and governed by this Privacy Policy, save and except for the business owner’s obligations as per this Section 9.
SECTION 10 – MODIFICATIONS AND AMENDMENTS TO THIS PRIVACY POLICY
Considering we may update our Platform and the services offered thereon, we may need to update this Privacy Policy from time to time. We reserve the right to update this Privacy Policy at our discretion. The date of the latest update made to this Privacy Policy will be specified at the top of this Privacy Policy.
It is the responsibility of users to review this Privacy Policy on a regular basis for changes. Users’ continued use of our Platform following the posting of updates to this Privacy Policy will constitute their acceptance of those updates. Information collected prior to the time any update is posted will be used according to the Privacy Policy in effect at the time the information was collected.
